Terms of Service

1. Introduction

These Terms of Service ("ToS") govern your use of LoadSnap, a digital waste compliance platform operated by Web Hero Limited ("we", "us", "our"), a company registered in England and Wales, with its registered office at 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ.

By accessing or using LoadSnap, you agree to be bound by these Terms. If you do not agree, do not use the platform.

2. The Service

LoadSnap provides digital waste tracking, compliance management, and DEFRA waste movement submission tools for waste carriers, receivers, brokers, and producers operating in the United Kingdom.

3. Account Responsibilities

You are responsible for:

  • Maintaining the confidentiality of your login credentials
  • All activity that occurs under your account
  • Ensuring that information you enter is accurate and up to date
  • Notifying us immediately of any unauthorised access

You must not share your account with anyone outside your organisation. Each user must have their own account.

4. Acceptable Use

You must not:

  • Use the platform for any unlawful purpose
  • Submit false or misleading waste data
  • Attempt to access other users' data
  • Interfere with the platform's infrastructure
  • Use automated tools to scrape or extract data
  • Reverse-engineer or decompile any part of the platform

5. DEFRA Submission

LoadSnap submits waste movement data to DEFRA on your behalf. However:

  • You are solely responsible for the accuracy of the data you enter
  • We act as a conduit for submission, not as a guarantor of data accuracy
  • You must verify all waste descriptions, EWC codes, weights, and carrier/receiver details before submission
  • Errors in submitted data are your responsibility to correct via DEFRA's amendment process

6. Data Accuracy

You warrant that all data entered into LoadSnap — including waste descriptions, weights, carrier registrations, site permits, and driver information — is accurate to the best of your knowledge. Deliberate entry of false data may result in account termination and referral to relevant authorities.

7. Service Availability

We aim to provide 99.9% uptime but do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance. We are not liable for losses arising from service interruption.

8. Intellectual Property

All content, code, design, and branding of LoadSnap is owned by Web Hero Limited. Your data remains yours. We do not claim ownership of any waste records, documents, or business data you upload.

9. Termination

We may suspend or terminate your account if you:

  • Breach these Terms of Service
  • Use the platform for illegal activity
  • Fail to pay subscription fees for more than 30 days

You may close your account at any time from Settings. Your data will be retained for the legally required period (see Privacy Policy) then deleted.

10. Limitation of Liability

To the maximum extent permitted by law, Web Hero Limited is not liable for:

  • Indirect, incidental, or consequential damages
  • Loss of profits or business opportunities
  • Errors in DEFRA submissions caused by incorrect data entry
  • Actions of third-party APIs (DVLA, DEFRA, Environment Agency)

Our total liability is limited to the amount you paid us in the 12 months preceding the claim.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified via email or in-app notification. Continued use after changes constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of England and Wales. Disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Subscription Terms & Conditions

1. Definitions

  • "LoadSnap" — the digital waste compliance platform operated by Web Hero Limited
  • "Organisation" — the business entity that creates an account on LoadSnap
  • "User" — any individual with access to the platform (admin, driver, operative)
  • "Subscription" — the paid plan selected by the Organisation
  • "Add-on" — optional features with additional charges (e.g. Driver Licence Checking)

2. Subscriptions and Billing

Plans:

  • Free (Starter): Limited features, no cost, no time limit
  • Trade: Single-vehicle self-carrier plan — up to 100 waste records per month, billed at £19/month (self-carriers only)
  • Pro: Enhanced features for small carriers, billed monthly or annually
  • Business: Full features for larger operations, billed monthly or annually
  • Enterprise: Custom pricing, billed by invoice

Free Trial:

New Trade, Pro and Business subscriptions include a 14-day free trial. No payment is taken during the trial. If no payment method is added before the trial ends, the account reverts to the Free plan. No data is lost.

Billing:

  • Subscriptions are billed in advance (monthly or annually)
  • Payments are processed via Stripe
  • All prices are in GBP and exclusive of VAT
  • Failed payments will be retried. After 3 failed attempts, the subscription may be suspended

Price Changes:

We may change subscription prices with 30 days' notice. Existing annual subscriptions are honoured until renewal.

3. Add-On Services

Driver Licence Checking (Beta):

  • Priced at £2.99 per consenting driver per month (exclusive of VAT)
  • Includes scheduled DVLA checks at your chosen frequency
  • Only drivers who have given explicit consent and entered their licence number are charged
  • Uses the DVLA Access to Driver Data (ADD) API
  • Each check costs 60p to DVLA (included in the £2.99/month charge)
  • Requires driver e-signature consent before any check is performed

4. Cancellation and Refunds

  • You may cancel your subscription at any time from Settings > Billing
  • Cancellation takes effect at the end of the current billing period
  • No partial refunds for unused time on monthly plans
  • Annual plans: pro-rata refund available within the first 30 days only
  • Free plan accounts can be closed at any time with immediate effect

5. Data Retention

  • Active accounts: data retained indefinitely while the account is active
  • Waste records: retained for a minimum of 3 years after creation (legal requirement under Environmental Protection Act 1990)
  • Cancelled accounts: data retained for 3 years then permanently deleted
  • Driver licence data: deleted immediately upon consent withdrawal
  • Chat messages: retained for 2 years
  • Audit logs: retained for 7 years

6. Third-Party API Usage

LoadSnap integrates with the following government APIs on your behalf:

  • DEFRA Waste Tracking API — for submitting waste movement data
  • DVLA Vehicle Enquiry Service — for vehicle MOT and tax status
  • DVSA MOT History API — for MOT test history
  • DVLA Access to Driver Data — for driving licence verification (add-on)
  • Environment Agency Public Register — for carrier/site compliance checks
  • Companies House API — for business verification

These services are provided by UK Government and are subject to their own terms. LoadSnap is not responsible for the availability or accuracy of third-party API data.

7. Limitation of Liability

Web Hero Limited's total liability under these Terms shall not exceed the total fees paid by you in the 12 months preceding the event giving rise to the claim.

We are not liable for:

  • Losses arising from data you entered incorrectly
  • Penalties from DEFRA, EA, or any regulator due to non-compliance
  • Losses caused by third-party API outages or errors
  • Loss of business or profits

8. Governing Law

These Terms and Conditions are governed by the laws of England and Wales.
